These Terms of Service ("Terms") form a binding agreement between you and kgw software ab ("we", "us", "our"), a company registered in Sweden, and govern your use of the Aetherium Clash game and related services (the "App"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.
You must be at least 13 years old and able to form a binding contract to use the App. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian who agrees to these Terms.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own entertainment, subject to these Terms and the terms of the app store you downloaded it from. We and our licensors retain all rights, title, and interest in the App and its content.
You are responsible for activity under your account and for keeping your sign-in secure. You may delete your account at any time from within the App (Profile → Delete Account).
The App includes virtual currencies — Shards, earned through play, and Gems, which may be purchased — and virtual cards and cosmetics (together, "Virtual Items"). Virtual Items are licensed to you, not sold; they have no monetary value, are not your property, and cannot be redeemed for cash or transferred outside the App. We may change, limit, or remove Virtual Items, or discontinue the App, and Virtual Items may be lost if your account is closed. Purchases are final except where mandatory consumer law requires otherwise; refunds for app-store purchases are handled by Apple or Google under their policies.
Purchases of Gems and other digital content are supplied immediately. If you are a consumer in the EU/EEA, by completing a purchase you expressly request immediate performance and acknowledge that you therefore lose your 14-day right of withdrawal once delivery of the digital content begins, as permitted by the EU Consumer Rights Directive. This does not affect your statutory rights in respect of faulty digital content.
The in-App marketplace lets players list and buy cards from one another using Shards only. It does not involve real money, and we are not a party to trades between players. We may remove listings or reverse transactions to address fraud, error, or abuse.
You are responsible for content you provide, including your public playname. You must not choose a name or behave in a way that is unlawful, offensive, infringing, or impersonating, and you agree not to cheat, exploit bugs, use unauthorized software or automation, harass other players, or attempt to disrupt or gain unauthorized access to the service. We may screen, reject, or change names and content that breach these Terms.
We may suspend or terminate access that violates these Terms or harms the service or other players. You may stop using the App and delete your account at any time. Sections that by their nature should survive termination (including Virtual Items, disclaimers, liability, and governing law) will survive.
The App is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim implied warranties and are not liable for indirect, incidental, or consequential loss, or loss of Virtual Items or data. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including your mandatory rights as a consumer.
These Terms are between you and us, not with Apple or Google. Apple and Google are not responsible for the App or its content and have no obligation to provide support for it. To the extent the App is obtained through the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you; you also agree to comply with the applicable App Store Terms of Service. Where an app store provides its own end-user licence terms, those terms apply to your use of the App in addition to these Terms.
We may modify, update, or discontinue features of the App. We may also update these Terms; where changes are material we will take reasonable steps to notify you, and continued use after changes take effect means you accept them. The effective date above shows the latest version.
These Terms are governed by the laws of Sweden, without affecting any mandatory consumer protections available to you in your country of residence. If you are a consumer, disputes may be brought before the competent courts, and you may also use the Swedish National Board for Consumer Disputes (ARN, arn.se) or the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr).
If any provision of these Terms is held unenforceable, the remaining provisions stay in effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms; we may assign them to an affiliate or successor. These Terms are the entire agreement between you and us regarding the App.
